Architectural Review Committee (ARC)

Article 5 of The Declaration of Covenants, Conditions and Restrictions (CC&R’s) of the Heritage Parks Association describes Architectural Control for the Association.

Section 5.1 states that there shall be No Improvements or Alterations Without Approval. No Improvement, excavation, landscaping, hardscaping, fence, wall, swimming pool, painting, alteration or other work which alters the exterior appearance of any Lot or its Improvements shall be commenced until plans and specifications, including color selections, a plot plan showing the location, height and external design of the structure or improvement, grading plans, and landscape plans have been submitted to and approved in writing by the Architectural Control Committee. If Improvements, additions, alterations, or modifications are different from those approved by the Architectural Control Committee, such Improvements, additions, alterations, or modifications shall be deemed disapproved and the Member shall promptly correct the nonconforming items to comply with the Architectural Standards, the Architectural Control Committee’s approvals, and City Requirements.

Section 5.6 of the CC&R’s provides that the Board shall appoint an Architectural Control Committee consisting of not less than three (3) nor more than five persons. If the Board does not appoint one, the Board shall automatically be deemed the Architectural Control Committee. The Architectural Control Committee shall have the authority to approve, reject, modify, give conditional approvals, and give limited approvals of Improvements and alterations as provided for in the Association’s Architectural Standards.

Section 5.8 of the CC&R’s describes the process for Submission of Plans. Plans and specifications in accordance with the Association’s Governing Documents shall be submitted to the Architectural Control Committee by personal delivery or certified mail. The plans submitted to the Architectural Control Committee shall show the exterior boundaries of the Lot, the location and height of all proposed structures or improvements, a landscape plan showing the location and maximum height (at full maturity) of any proposed trees, shrubbery or other improvements which could obstruct the view from a residence constructed or to be constructed on another Lot, all existing easements on the Lot and any other information requested by the Architectural Control Committee. Unless a delay in approval by the Architectural Control Committee is the result of (i) the applicant’s failure to properly submit an application in accordance with the Association’s guidelines, or (ii) a reasonable request by the Architectural Control Committee for additional information, the application shall be deemed approved within 30 days of being submitted to the Architectural Control Committee unless the application has been disapproved by the Architectural Control Committee. Provided, however, that all applications that violate the Association’s Governing Documents or Building and Safety Codes are automatically disapproved without action by the Architectural Control Committee unless variances are specifically approved in writing by the Architectural Control Committee. Approvals by the Architectural Control Committee may contain conditions or requests for modification of particular aspects of the Member’s architectural submission.



    
Architectural Review Committee Guidelines
OVERHEAD TRELLlS-WOOD STRUCTURES-GAZEBOS
• Not to exceed 9' -0" in height, unless otherwise specifically approved
• Natural redwood or pre-approved paint color
• Not to be attached to fences
• Verify setback requirements with the City - distances from property lines
• No clotheslines can be hung from structure
• No plastic or fiberglass materials may be placed on the structure
 
SHEDS WILL ONLY BE ALLOWED WITH PRlOR ARCHITECTURAL APPROVAL
 
SPAS & POOLS
• Permanent fixtures must be pre-approved
• Verify setback requirements with the City
• Permits must be applied for and granted by City
 
CONCRETE PATIOS
• Maintain existing drainage pattern or improve by installing drainage pipe
• You must not allow your water drainage to enter into someone else's yard
• No additions on front patios
 
DRIVEWAY EXTENSIONS ARE NOT ALLOWED
 
FRONT YARD FOUNTAINS ARE NOT ALLOWED
 
MAINTENANCE OF RESIDENCES
• Homeowners must prune and maintain plants, trees, and shrubs so as not to become unsightly, block views of or infringe upon neighboring properties
• No unimproved dirt areas in front yard
• No climbing vines or shrubs against common fences
 
ADDITIONS
• Additions will be allowed as long as they are approved and compatible with existing architectural quality, materials, and colors
• No metal or aluminum-style additions are permitted
• All additions must meet County setback requirements
 
NOISE CONTROL
• Outside work hours Monday to Friday are between the hours of 8:00 AM am and 6:00 PM, Saturday between the hours of 9:00 AM and 5:00 PM per the City of Scotts Valley
 
HARDSCAPE DETAILS
• Mailbox changes, columns, permanent poles, flag poles, must be submitted for approval
• No garbage can structures are allowed in front yard• Playhouses/swing sets must be approved
 
FENCING
All new and/or replacement fencing must be approved by the Architectural Review Committee (ARC).

There are ARC Guidelines for front yard fencing, back/side yard fencing, and fences bordering Open Space.

FRONT YARD FENCING
Natural split rail fencing is allowed in front yards. They must be constructed of wood and be properly installed by a professional landscaper or fencing company.
  • No entry gates in front of home or driveway are allowed
  • The setback of the split rail fencing should be no higher than 36 inches and setback must not exceed 36 inches from sidewalk or property line.
  • No other front yard fencing is allowed in Heritage Parks Homeowner Association.
  • Here is an example of an acceptable split rail fencing style:



BACKYARD & SIDE YARD FENCING
  • Wood fencing is preferred for back/side yards where neighbors share fences or where fences provide privacy along the street. Other non-flammable materials will be considered on a case-by-case basis. All fences, regardless of material, must be wood-tone and blend with the original fencing.
  • Fencing must be maintained at 6'-0" height maximum or as originally constructed.
  • All fencing must be “A Good Neighbor Fence.” 
    • A “Good Neighbor Fence” is a privacy fence that divides two properties, where the finished side of the fence (i.e., the attractive smooth side) faces the neighbor's property. The homeowner who is building the fence then has a view of the rails and posts from inside their yard. You can also have 2-sided fencing with overlapping boards where both sides are smooth, and both have attractive sides.
  • Fencing may be a natural clear stain/sealant. Any color or painted fences must be pre-approved.
  • Dog-eared style fencing is not allowed.
  • Any exceptions to these fencing guidelines will be reviewed on a per case basis by the ARC. This includes lattice, arches over backyard entry gates and/or modifications to entry gates themselves.
FENCES BORDERING OPEN SPACE
  • Fences that border open space can be Boxed Wire fencing with a height maximum of 7-½ feet. Any exceptions must be approved by the ARC committee.
  • Open Space fencing materials may include wood, metal posts or wrought iron. All materials should blend with the environment. Any changes to original materials used for replacement will be evaluated on a case-by-case basis by the ARC.
  • A wrought iron or metal fence shall consist of plain rectangular posts, typical on 4-inch centers, welded or with associated hardware that are capped by plain horizontal rectangular rails. Metal or wrought iron fences shall not exceed 6 feet. No arches, decorations or trellis may be affixed to wrought iron/metal fencing. Wrought iron or metal fences shall be colored flat black or flat weathered brown.
  • Open Space fencing on homes above Saddleback Ridge may be constructed from heavy duty polypropylene with a height maximum of 7-½ feet Heavy duty polypropylene fencing will be considered on a case-by-case basis.


• Fencing must be maintained at 6'-0" height maximum or as originally constructed
• Fencing must be wood, no wrought iron style gates or fences with the exception of patio fencing
• Fences must not be painted unless pre-approved, (natural clear stain or sealant is permitted)
• No lattice, etc., shall be added above the fence line without prior approval
• All other materials well be reviewed on a per case basis
 
PAINTING HOUSE
• Colors must be compatible with houses in area and must be pre-approved.
• Colors must be compatible with each other (base and trim)
• Color changes from original will be generally discouraged
 
SCREEN DOORS
• No silver color aluminum screen doors are allowed
• Screen doors must be painted to match trim of door
• Screen doors must be pre-approved before installation - provide brochure or sample
 
OUTSIDE CLOTHES LINES ARE NOT ALLOWED
 
TV ANTENNAS OR SATELLITE DISHES
• Only satellite dishes smaller than 1 meter will be allowed
